new provisions | employment
An act amending the Labour Code and other laws comes into force from 1 January 2011, establishing a new public holiday on Epiphany (January 6).
The rules for calculating working time will also change. Should the holiday be on a day off from work pursuant to agreed time schedule and in accordance with distribution of working time in the average five-day working week, this will not reduce working hours. The mechanism “substituting” a day off in lieu for a holiday falling on a non-working day according to the average five-day working week (e.g. on a free Saturday) will no longer apply.
As a result, in arranging work schedules for of individual workers, an employer may also designate free days falling on holidays that are on days other than Sunday and will not reduce working time for this reason, i.e. the number of hours that the employee must work over the adopted settlement period.
