Uniform principles for the remuneration of contractors

A new act implementing certain European Union provisions on equal treatment is awaiting signature by the President and will probably come into force as of the New Year.

Among other things, it is to introduce a prohibition on discrimination against persons performing work under civil contracts.
Not only wage differentiation, but actions such as refusing the right to leave when other persons employed under civil contracts (management contracts, contracts of mandate) have the same entitlements, shall also constitute discrimination.
Discretion shall thus be eliminated when drawing-up terms and conditions of employment for persons employed under civil contracts.
Wronged parties will be able to pursue damages from an entrepreneur (company). The burden of proving that there was no breach of the principle of equal treatment shall rest with the entrepreneur (company).
