New courts established
The Regulation of the Minister of Justice of 7 October 2014 on Establishment of Certain District Courts came into force on 1 January 2015.
Under this regulation, 41 new district courts were established in Poland, with the greatest number—12 of them—in the province of Wielkopolska.
This change affects the determination of the court with geographical jurisdiction over disputes (governed by Art. 27–30 of the Civil Procedure Code). The existence of the new courts must also be taken into consideration when filing commercial cases, which are important for business litigants.
The number of regional courts (45) and courts of appeal (11) remains unchanged.
The current list of all common courts in Poland as of 1 January 2015 is set forth in the Regulation of the Minister of Justice of 7 October 2014 on Establishment of the Seat and Area of Jurisdiction of Courts of Appeal, Regional Courts and District Courts.
The changes should be borne in mind in the context of any pending judicial proceedings.
